The website and related features are referred to in these Terms of Use as the "Site." The Site is owned and operated by Gonzalez & Rothchild LLP ("Gonzalez & Rothchild," the "Firm," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, you should not use the Site. Please also review the Firm's Privacy Policy, Notice of Privacy Practices, and Third-Party Vendor List, as applicable.

Informational Purposes Only

The Site is provided for general informational purposes only. Nothing on the Site constitutes legal advice, and you should not act or refrain from acting based on information on the Site without seeking advice from qualified counsel regarding your specific circumstances. No Attorney-Client Relationship

Your use of the Site, including submitting a contact form, completing an intake form, scheduling a consultation, sending an email, calling the Firm, or otherwise communicating with the Firm, does not create an attorney-client relationship. An attorney-client relationship is formed only after the Firm has completed any necessary conflict check, agreed in writing to represent you, and you have signed an engagement letter with the Firm.

Website Inquiries and Intake Submissions

The Site may allow you to submit inquiries, schedule consultations, complete intake forms, upload information, or otherwise provide information to the Firm through tools operated by or integrated with third-party legal technology providers, including Clio. These tools may be used to help the Firm receive inquiries, organize intake information, evaluate potential matters, conduct conflict checks, communicate with prospective clients, and determine whether the Firm may agree to provide legal services. Submitting information through the Site or through any Firm intake process does not obligate the Firm to represent you, and the Firm may decline representation for any reason, including conflicts, capacity, subject-matter fit, jurisdictional limitations, or other professional considerations.

Do Not Send Unrequested Confidential Information

Unless and until the Firm has agreed in writing to represent you, you should not send unrequested confidential, privileged, proprietary, sensitive, or time-sensitive information to the Firm through the Site, by email, or through any intake tool. Communications sent before an attorney-client relationship is formed may not be protected by the attorney-client privilege and may not prevent the Firm from representing another person or entity in the same or a related matter, except to the extent otherwise required by applicable law or professional obligations. The Firm may use information submitted through the Site or intake process to review your inquiry, conduct conflict checks, evaluate whether the Firm may represent you, communicate with you, and administer Firm operations.

No Guarantee of Results; Attorney Advertising

The Site may constitute attorney advertising under applicable law and professional rules. Any descriptions of the Firm's services, experience, representative matters, prior results, settlements, verdicts, or case outcomes are provided for informational purposes only. Prior results do not guarantee or predict a similar outcome in any future matter. Unless expressly stated, no attorney of the Firm is certified by the Texas Board of Legal Specialization.

User Eligibility

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GONZALEZ & ROTHCHILD LLP AND ITS PARTNERS, ATTORNEYS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE SITE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS OF USE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Indemnity

You agree to indemnify and hold harmless Gonzalez & Rothchild LLP and its partners, attorneys, employees, contractors, representatives, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms of Use, your violation of applicable law, or your violation of any third-party rights.

Class Action Waiver

To the maximum extent permitted by law, you and the Firm each waive the right to participate in any class, collective, consolidated, private attorney general, or representative action arising out of or relating to the Site or these Terms of Use.

Governing Law and Forum

These Terms of Use and any dispute arising out of or relating to the Site or these Terms of Use are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You and the Firm agree that any dispute arising out of or relating to the Site or these Terms of Use shall be resolved on an individual basis exclusively in the state or federal courts located in Harris County, Texas, and each party consents to personal jurisdiction and venue in those courts. Notwithstanding the foregoing, the Firm may seek injunctive or equitable relief in any court of competent jurisdiction.

Changes to These Terms

The Firm may update these Terms of Use at any time. Changes are effective when posted on the Site unless otherwise stated, and your continued use of the Site after changes are posted means that you accept the revised Terms of Use.

General Terms

If any provision of these Terms of Use is held unlawful, void, or unenforceable, the remaining provisions will remain in effect. The Firm's failure to enforce any provision of these Terms of Use is not a waiver of that provision or any other provision. These Terms of Use constitute the entire agreement between you and the Firm regarding your use of the Site.
